1.Coverage

The business relationship between La Bonita Beauty Spa and the client (purchaser) – for any and all future business – is subject to the following general Terms and Conditions at the time the order is placed. La Bonita Beauty Spa does not acknowledge different conditions of the purchaser unless expressly agreed upon in writing by La Bonita Beauty Spa, Sonia Kieberl.

 

2.Conclusion of contract and cancellation

La Bonita Beauty Spa undertakes to accept the purchaser’s appointment on the conditions of the site. La Bonita Beauty Spa reserves the right to cancel appointments due to writing, printing or calculation errors on the website.

All offers are valid while supplies last.

 

3.Delivery

Unless otherwise agreed, the delivery from warehouse to the purchaser’s delivery address. The risk passes to the client as soon as the goods leave the premises of La Bonita Beauty Spa, and indeed even in the case of partial deliveries. Information about the delivery deadline is not binding, unless the date of delivery was guaranteed.

 

4.Date of payment, default

The delivery of La Bonita Beauty Spa products are upon receipt of cash. If La Bonita Beauty Spa is damaged by intentional misrepresentation, intentional or incorrect orders or by unfounded return that goes beyond the granted right of withdrawal, La Bonita Beauty Spa is entitled make this claim.

 

5.Refunds

The purchaser is entitled to a refund only if the purchaser’s counterclaims have been legally established or recognized by La Bonita Beauty Spa. The purchaser has the right to a refund only insofar as his counterclaim is based on the same contract.

 

6.Conditions of sale

Until complete settlement of all claims against the purchaser, supplied goods remain the  property of La Bonita Beauty Spa.

 

7.Warranty and liability

If La Bonita Beauty Spa is responsible for a defect or lack of purchased item, La Bonita Beauty Spa is entitled to choose whether to repair or replace the goods. If La Bonita Beauty Spa is unable or unwilling to refund, replace or repair the goods in an adequate period of time, the purchaser is entitled to either withdraw from the contract or demand a corresponding price reduction. Unless otherwise stated, further claims by the purchaser – for whatever legal reasons – are excluded. La Bonita Beauty Spa is not liable for damage, lost profits or other financial losses of the purchaser caused by the items themselves. If the liability of La Bonita Beauty Spa is excluded or limited, this also applies to the personal liability of employees, representatives and agents. The above limitations shall not apply if the damage is caused by intent or gross negligence. If La Bonita Spa Beauty negligently violated a contractual obligation, the obligation to pay compensation for property damage or personal injury to the typical damage is limited. The warranty period is six months from the transfer of risk. This period is a statute of limitations and applies to claims for consequential damages, provided any claims are asserted.

 

8.Data Protection

The purchaser has been informed in detail about the nature, extent, location and purpose of the collection, processing and use of services required for the execution of orders, notification to the Email notification service, the transmission of personal data by La Bonita Beauty Spa. The buyer expressly agrees to this collection, processing and use of personal data.

 

9.Governing law and jurisdiction

Austrian law applies under the exclusion of the UN sales law. The exclusive jurisdiction for all claims in connection with the business is Vienna, Austria. La Bonita Beauty Spa has the right to sue at the court of jurisdiction. 

 

10.Returns

You have a 10 day sale or return period.
We want you to be satisfied with our deliveries, and merchandise return is simple. You can return related articles to us – provided that they are in the original packaging
and are undamaged – within 10 days and get back the purchase price.

After placing your order you will receive an email with your purchase confirmation. If you decide that you do not need the product, we ask for your written cancellation of the order. To continuously improve our service, we ask that you help us by providing comments for the return.

Always send returned goods unregistered; registered or abandoned packages will not be accepted. Shipping costs will be refunded to you if there has been a delivery error on our part is, or if the goods have been damaged in delivery. 

 

11.Shipping

Within Austria, a shipping-fee of € 4.90 is charged on orders under € 100.00.
For orders of more than € 100.00 there is no shipping charge (except for cash-on-delivery shipments). For international orders, a flat rate shipping fee of € 14.50 is charged.
For cash-on-delivery (COD) shipments within Austria a flat rate of € 6.90 is charged. 

If the goods are delivered properly but are refused by the purchaser, we will bill the purchaser for postage costs (for both shipping and the return).

All in-stock items will be delivered between 2-5 business days. If an item is not in stock, we inform you and give you the expected delivery date. Deliveries to countries outside of the EU will be charged a shipping fee, details of which are available on request by telephone.

Payment: We offer payment on delivery, prepayment or cash on collection.

 

12.Cancellation Policy

Appointments booked are generally binding and reserved for you with one of our staff. We do understand that cancelling can sometimes not be avoided. If so, we kindly ask our customers to inform us at least 24 hours in advance. Please read our cancellation policy for further information:

For appointments that are cancelled within 24 hours before the date we will charge 50% of the price of the treatments booked. If you do not inform us at all 80% will be charged. This also applies if paid with a voucher or gift cards.
